NITHYANANDA FACES FRESH COMPLAINT OF FRAUD AND RACKETEERING IN USA

1 more complaint has been filed against Nithyananda in USA for FRAUD AND DECEIT, RACKETEERING, CIVIL CONSPIRACY and UNFAIR BUSINESS PRACTICES, cheating the US government and donors by misusing the charitable, tax-exempt 501(c) status. The complaint (Case no. EDCV13-363-JGB, filed on 27^th Feb 2013 at the US District Court, Central District of California) has been filed by several ex-donors against Nithyananda, his secretaries and his organizations, allege that Nithyananda and his secretaries blatantly misrepresented Nithyananda as a Brahmachari, sanyasi living a simple life, and misrepresented the organizations as charitable institutions benefitting the society and extracted crores of rupees from them. But in reality Nithyananda’s intentions were to cheat the public, devotees and the US government by misusing his position as the leader of these organizations and charitable tax-exempt (501(c)) status of his organizations to privately benefit from it (refer pg 50 of complaint). The ex-donors have demanded the return of around $800,000 (around Rs. 4.5 crores) collected from them through fraud and deceit. However, the court could award 3 times that amount (almost Rs. 14 crores) as compensation, if the racketeering charges are confirmed in a trial.

The defendants named in the complaint are: (i) Nithyananda (Accused 1 in India), (ii) Gopal Reddy Sheelum @ Nithya Bhaktananda (Accused 2 in India) – already declared FRAUD by US Court in July 2012 in another case 5:11-CV-01304 SVW (SPx), Popatlal Savla vs Nithyananda Foundation (iii) Siva Vallabhaneni @ Nithya Sachitananda (Accused 3 in India), (iv) Nithyananda Foundation – also declared FRAUD by US Court in July 2012 in case no. 5:11-CV-01304 SVW (SPx), Popatlal Savla vs Nithyananda Foundation, (v) Life Bliss Foundation in Montclair (Los Angeles), California (vi) Nithyananda Dhyanapaatem Temple and Cultural Center (NDTCC) in Montclair (Los Angeles), California and (vii) Dhyanapeetam Charitable Trust in Bidadi, India

In July 2012, in the same California court, a jury reviewed all evidence and found Nithyananda Foundation and Gopal Reddy Sheelum guilty of committing fraud against another ex-donor Mr. Popatlal Savla and ordered them to return the $1.5 Million (~ Rs 8 crore) that was fraudulently obtained from him (see link below for judgment from that case). But the details of the allegations (which are explained below) and evidence presented in this latest complaint shockingly exposes well planned efforts and criminal intent of Nithyananda and his secretaries Gopal Reddy Sheelum (@Bhaktananda, A2) and Siva Vallabhaneni (@ Sachitananda, A3) to cheat the public and government.

The allegations in the complaint and other sections of interest are briefly explained below:

·  Fraud and Deceit (Refer complaint, Pg 17, 25, 28, 29, 37, 39-40, 47, 50-51)

Publicly and privately Nithyananda over emphasized that he lived a very simple life and he was a Brahmachari Sanyasi (Pg 17). He intentionally misrepresented his organizations as charitable tax-exempt (501(c) status) institutions exclusively for charitable activities for the benefit of the society. But in fact it was benefitting Nithyananda his secretaries, and other individuals, as large amounts collected in US were transferred to Nithyananda’s bank account. (Pg 28, 37)

· Nithyananda confessed about Sex with many and video being authentic: (refer Pg 25)

Nithynanda personally confessed to donors in March 2010 about video being true (not morphed as he alleged later), that he had sex with many persons, that the sex-contract (i.e. NDA or  Non-Disclosure Agreements) were being used for many years (atleast since 2005). Nithyananda also admitted that he misrepresented his organization as being charitable entities, because most of the money collected in USA through his organizations was sent to Nithyananda. (Refer Pg 25 for more details). Nithyananda and his secretaries have also confirmed about existence of the NDA (Non-Diclosure Agreement, better known as “sex contract”).  (refer Pg 40)

· Financial fraud by Nithyananda organizations: (refer Pg 28, 29, 47)

Nithyananda organization cannot account for more than $2 million, they have no records of how they spent $3.6 million!!! Based on evidence in previous trial (in Popatlal Savla vs. Nithyananda Foundation), an expert testified that Nithyananda entities have 2 sets of books, and worst of all, the books (financial records) were cooked to make $2 million profit turn into $2 million loss. More details in pg 28,29, 47

· Civil Conspiracy (refer Pg 29-33)

Nithyananda and his secretaries have elaborately planned to destroy evidence and strip all the assets of entities in Nithyananda organizations, to avoid paying if they face lawsuits. Nithyananda and his secretaries specifically discussed that many people have expressed about sexual abuse incidents happening to them, and so they were concerned about potential lawsuits. (Pg 31). Details of plans and email discussions are in pg 29-33 & Exhibit F

·  Racketeering (pg 16)

Nithyananda and his secretaries Gopal (Bhaktananda) and Siva (Sachitananda) operated the assets of the charitable organizations as their own personal ATM and piggy bank. Large sums of money moved from USA to India through Nithyananda’s brother’s company called “Nithyananda Import Export”.

While Nithyananda claims to have no connections whatsoever with Nithyananda Foundation or his other organizations, the complaint infact goes to say that Nithyananda controlled the organizations to such a great degree that Nithyananda and his Organizations are one and the same, there is no separation between them (Refer pg 13-15)

This latest complaint against Nithyananda, which is similar to a class action lawsuit, was filed by 6 ex-donors on 28^th Feb 2013. Interestingly, around the same time 3 years ago (on 2^nd Mar 2010), truth about Nithyananda came to light!

சென்னை, பிப்.16- சென்னை உயர்நீதி மன்றத்தில் திருவண்ணா மலை நித்தியானந்தா பீடத்தின் மேலாளர் நித் திய பரமானந்தர் மனு ஒன்றை தாக்கல் செய்தி ருந்தார். அதில், நித்தியா னந்தா பீடம் ஒரு வழி பாட்டிடமல்ல. அங்கு மதச் சடங்குகள், பூஜை கள் எதுவும் நடத்தப்படு வதில்லை.

எனவே இந்து சமய அறநிலையத்துறை சட்டம் எதுவும் எங்கள் பீடத்தைக் கட்டுப்படுத் தாது. ஆனால் எங்கள் பீடத்தை கையகப்படுத் துவதற்காக கடந்த அக் டோபர் 11 ஆம் தேதி இந்து சமய அறநிலையத் துறை உதவி ஆணையர் நோட்டீசு அனுப்பியுள் ளார். அந்த நோட்டீசை ரத்து செய்ய வேண்டும் என்று கூறியிருந்தார்.

இந்த மனுவை நீதிபதி கே.சந்துரு விசாரித்தார். அங்கு இந்து ஆகம விதி களும் பின்பற்றப்பட வில்லை. சில இந்து கட வுள்களின் சிலைகள் அங்கு இருப்பதை வைத்து அது இந்து மதத்தை பின்பற்றும் சமய பீடம் என்று கூற முடியாது. எனவே திருவண்ணா மலையில் உள்ள நித்தி யானந்தா பீடம், இந்து சமய அறநிலை யத்துறை யின் கட்டுப்பாட்டுக்குள் வராது என்று கூறி உதவி ஆணையரின் நோட் டீசை ரத்து செய்து கடந்த ஜனவரி 31 ஆம் தேதி உத்தரவிட்டார்.

இந்த உத்தரவை எதிர்த்து உயர்நீதிமன்றத் தில் இந்து சமய அற நிலையத்துறை ஆணை யர் மேல்முறையீட்டு மனு தாக்கல் செய்துள் ளார்.  அதில் அவர் கூறி யிருப்பதாவது:-

இந்து கடவுள்களின் சிலைகள் மட்டும்தான் அந்த பீடத்தில் இருந் தன. அறநிலையத்துறை நோட்டீசு அனுப்பிய பிறகுதான் அங்கு புத்தர் சிலைகள் வைக்கப்பட் டன. அந்த பீடத்தில் யோகா, தியானம் ஆகிய வற்றுக்கான பயிற்சி அளிக்கப்படுகிறது. இது இந்து மதத்துக்கு உரித் தான பாரம்பரியமாகும். அங்கு நடக்கும் பூஜை களை இந்து அர்ச்சகர் களை சம்பளத்துக்கு அழைத்து அவர்கள் மூல மாகவே நடத்துகின்ற னர்.

பவுர்ணமி காலத்தில் திருவண்ணாமலைக்கு வரும் பக்தர்களுக்கு இந்த பீடத்தில் அன்ன தானம் வழங்கப்படு கிறது. இதுவும் இந்து முறைப்படியான விஷ யம்தான். நித்தியானந்தா பீடம், இந்து சடங்கு களை பின்பற்றும் மடம் என்பதை தனி நீதிபதி கவனிக்க தவறிவிட்டார். எனவே தனி நீதிபதியின் உத்தரவை ரத்து செய்ய வேண்டும்.

திருவண்ணாமலை நித்யானந்தா பீடம் மாநில இந்து சமய அறநிலையத் துறையின் கட்டுப்பாட்டுக்குள் வராது என்ற உயர் நீதிமன்ற தனி நீதிபதியின் தீர்ப்பை எதிர்த்து தமிழக அரசு மேல் முறையீடு செய்துள்ளது.

திருவண்ணாமலையில் உள்ள நித்யானந்தா பீடத்தை கையகப்படுத்துவது தொடர்பாக இந்து சமய அறநிலையத் துறை உதவி ஆணையர் கடந்த ஆண்டு அக்டோபர் 11-ஆம் தேதி அந்த பீடத்துக்கு நோட்டீஸ் அனுப்பினார்.

இந்த நோட்டீûஸ ரத்து செய்யக் கோரி பீடத்தின் மேலாளர் நித்ய பரமானந்தர் உயர் நீதிமன்றத்தில் மனு தாக்கல் செய்தார்.

இந்த வழக்கை விசாரித்த நீதிபதி கே. சந்துரு, நித்யானந்தா பீடம் இந்து மத ஆகம விதிகள் அடிப்படையில் செயல்படும் அமைப்பு அல்ல.

அனைத்து மத, ஜாதியினரும் அங்கு செல்கின்றனர். அந்த பீடம் இந்து சமய அறநிலையத் துறையினரின் கட்டுப்பாட்டுக்குள் வராது. ஆகவே அந்த பீடத்துக்கு அனுப்பப்பட்ட நோட்டீஸ் ரத்து செய்யப்படுகிறது என்று தீர்ப்பளித்தார்.

கும்பமேளாவின் யோக்கியதை இதுதான்! பட்டத்தைப் பணம் கொடுத்து வாங்கினார் நித்யானந்தா

அலகாபாத், பிப்.14- அலகாபாத்தில் நடை பெற்றுவரும் கும்ப மேளாவில் நித்தியானந் தாவுக்கு மகா மண்ட லேசுவரர் பட்டம் வழங் கப்பட்டுள்ளது. இந்த பட்டத்தை பணம் கொடுத்து வாங்கியதாக சாதுக்களின் உயர் அமைப்பான அகாரா பரிஷத் குற்றம் சாட்டி யுள்ளது.

கும்பமேளா விழா உத்தரப்பிரதேச மாநி லம் அலகாபாத்தில் கடந்த ஜனவரி மாதம் 14 ஆம் தேதி தொடங்கி யது.

பெங்களூருவை அடுத்துள்ள பிடதியில் தியான பீடம் நடத்தி வரும் நித்தியானந்தாவும் மகா கும்பமேளாவில் கலந்து கொண்டார். திரி வேணி சங்கமம் அருகே நடந்து வரும் கும்ப மேளா விழாவில் மகா நிர்வாணி அகாரா என்ற அமைப்பு நித்தியானந் தாவுக்கு மகாமண் டலேசுவரர் என்ற பட் டத்தை வழங்கியுள்ளது. இந்த பட்டம் வழங்கிய தற்கு சாதுக்கள் மற்றும் மடாதிபதிகளின் உயர் அமைப்பான அகாரா பரிஷத் கண்டனம் தெரி வித்திருக்கிறது. மேலும் இந்த விருது வழங்கி இருப்பதில் பணப் பரி மாற்றம்-ஊழல் நடந்து இருப்பதாகவும் குற்றம் சாட்டி இருக்கிறது. இது பற்றி அகாரா பரிஷத் தின் தலைவர் மகந்த் ஞானதாஸ் கூறியதா வது:-

நித்தியானந்தாவுக்கு மகா மண்டலேசுவரர் விருது வழங்கி இருப்ப தில் பணப்பரிமாற்றம் நடைபெற்று இருக் கிறது. திரிவேணி சங்க மத்தில் நடந்த விழாவில் மகா நிர்வாணி அகாரா, நித்தியானந்தாவை மகா மண்டலேசுவராக பட் டம் சூட்டி இருக்கிறது. இந்த விழாவை ஏராள மான சாதுக்கள், மடா திபதிகள் புறக்கணித் துள்ளனர். நித்தியானந் தாவுக்கு மகா மண்டலே சுவரர் பட்டம் கொடுப் பது கடைசி நிமிடம் வரை ரகசியமாக வைக் கப்பட்டு இருந்தது.

மகா மண்டலேசுவரர் பட் டம் பெறுவது என்பது மிக நீண்ட ஆன்மிக நடவடிக்கை. ஆனால் சிலர் அதனை பணத் தால் அடைய முயற்சிக் கிறார்கள். இதுபோன்ற நடைமுறைக்கு முற்றுப் புள்ளி வைக்க வேண்டும். கடந்த 2010 ஆம் ஆண்டு ஹரித்துவாரில் நடை பெற்ற கும்பமேளாவில் நித்தியானந்தாவின் கூடாரம் சாதுக்களால் சேதப்படுத்தப்பட்டது.

ஆனால் அதுபோன்ற சம்பவம் இங்கு நடை பெறவில்லை. காரணம் மகா மண்டலேசுவரர் பட்டம் பணப் பரி மாற்றத்தின் மூலம் பெறப்பட்டுள்ளது. சாதுக்கள், மடாதி பதிகள் அடங்கிய உயர் நிலைக்குழு கூட்டம் கூட்டப்படும். இந்த கூட் டத்தில் மகா மண்டலே சுவரர் பட்டத்தை முறை கேடாகப் பெற்றிருப் பது உறுதியானால் நித் தியானந்தா நீக்கப்படு வார்.

அகாடாவில் அவர் சேர்வதற்கும் சம்பந்தமில்லை.தென் மாநில சாதுக்களை, கும்பமேளாவில் சேர்த்துக் கொள்வதில்லை என்ற குற்றச்சாட்டும் உள்ளது. அதற்கு பதில் அளிக்கும் விதத்தில் தான், நித்யானந்தாவை சேர்த்துள்ளோம்.இவ்வாறு அவர் தெரிவித்தார்.ஆனால், "இந்த நடவடிக்கை, நியாயமானதல்ல. நியமனத்திற்கு முன், மற்ற அகாடாக்களின் கருத்தையும் கேட்டிருக்க வேண்டும்' என, நிரஞ்சனி அகாடா என்ற மற்றொரு அமைப்பு கண்டனம் தெரிவித்துள்ளது.இந்த அமைப்பை சேர்ந்த ஹரிகிரி என்பவர் கூறுகையில், ""ஒருவரை மகா மண்டலேசுவரராக நியமிப்பதற்கு முன், அவரது நடத்தை, பின்னணி பற்றி ஆராய்ந்து முடிவெடுக்க வேண்டும். நித்யானந்தாவை எப்படி நியமித்தனர் என, தெரியவில்லை,'' என்றார்.மகா மண்டலேசுவரராக நியமிக்கப்பட்ட பின், தன், 220 சீடர்களுடன் நித்தி, நேற்று முன்தினம் காசிக்கு வந்தார். கங்கையில் படகில் சென்று, சில கட்டங்களை பார்த்து விட்டு, பின், 60 சீடர்களுடன் விசுவநாதர், அன்னபூரணி மற்றும் விசாலாட்சியை தரிசித்தார்.மதுரை ஆதினகர்த்தவாக ஆக முயன்று, சர்ச்சையில் சிக்கிய நித்தியானந்தா, வடமாநிலங்களில் காலூன்ற முதல் கட்டமாக, மகா மண்டலேசுவரராக நியமனம் பெற்றுள்ளார் என்று கூறப்படுகிறது.

அகாடா என்றால்...?

வட மாநிலங்களில் உள்ள துறவிகள், "அகாடா' என்ற பெயரில் அமைப்புகளை ஏற்படுத்தி ஒன்றிணைந்து செயல்படுகின்றனர். தென் மாநிலங்களில் பல்வேறு மடங்கள் இருந்தாலும், அகாடா போன்ற அமைப்பு கிடையாது.தென் மாநில மடங்களில் எதுவும், இந்த அகாடா அமைப்பில் சேரவில்லை. இந்த அகாடாக்களில், துறவிகள் குழுவுக்கு தலைவராக இருக்கும் துறவி, மகா மண்டலேசுவரர் எனப்படுவார். இது அதிகாரமும், செல்வாக்கும் மிக்க பதவி. இதில், சைவ, வைணவ மற்றும் தனியான பிரிவாக, "உதாசீன்' என்ற பிரிவும் உள்ளது. இம்மாதிரி, மொத்தம், 13 அகாடா பிரிவுகள் உள்ளன.



நூறு பேருக்கு கிடைத்த பதவி

Nithyananda is expected to reach Kumbh mela township today (Feb 4) and stay at the holy place for ten days. His followers have erected a huge pandal. What attracted the attention of the people to the pandal and subsequent campaign against the swamy was the 8-ft statue of his installed at the pandal. His followers were doing daily puja to the huge statue of his and holding meditation sessions. But these holy rituals do not seem to have any difference to the public mood. 

A section of pilgrims have met distirct administration and sought to put restrictions of Nithyananda. They are enraged by the fact that a person like Nithyananda coyuld be coming to the holy place considering charges against him. The pilgrims have also expressed their anger about the activities in the Nithyananda pandal.

Court Rejects Nithyananda's Petition: Green signal given to film "Satyananda"

A local court today showed green signal to the release of Kannada film "Sathyananda" which was stayed last year after self-styled godman Nithyananda alleged that the film was defamatory to him. 

 The 15th Additional City Civil judge Master R K N M S Mahaswamiji gave the go-ahead, subject to the condition that the title would be changed and certain portions of the film would be deleted before its release.

 The trial of the defamation suit filed by Nithyananda against the film will commence from March 26.  
Nithyananda has sought for Rs 3.5 crore along with exemplary damages from producer and director Madan Patel. 

 Sources close to Nithyananda indicated he would file an appeal in the High Court challenging the order.

Court Order on 'Sathyananda' IndiaGlitz [Saturday, February 02, 2013

The controversy leading to 'Sathyananda' Kannada and Telugu film by Madan Patel came up before the city civil court on Friday in Bangalore. The city civil court has instructed for change in the title and omission of a few scenes in 'Satyananda' film. The order has come up after hearing the complaint filed by Sri Nithyananda Swamy advocates. The order to change the title 'Sathyananda' and scenes related to Nithyananda Swamy have to be cut off.  The controversy related to this film in the court battle since 2011. The legal cell of Swami Nithyananda strongly objected to the film screening and filed a defamation case to the tune of Rs.5 crores. The stay order was also brought for the release of the film till the court verdict. Madan Patel questioned this at High Court of Karnataka. On the advice of High Court of Karnataka the city civil court viewed the film and passed order suggesting title change and omission of a few scenes that has direct remark on Swami Nithyananda.

மதுரை: மதுரை ஆதீனத்தின் இளைய ஆதீனம் பொறுப்பில் இருந்து தன்னை நீக்கியது தவறு என்றும், மதுரை ஆதீன மடத்தில் பூஜைகள் நடத்த தனக்கு அனுமதி அளிக்க வேண்டும் என்றும் கேட்டு மதுரை நீதிமன்றத்தில் நித்தியானந்தா மனு தாக்கல் செய்துள்ளார். 

மதுரை ஆதீனத்திற்கு எதிராக மதுரை மாவட்ட முதன்மை சார்பு நீதிமன்றத்தில் நித்தியானந்தா புதிதாக 2 வழக்குகளை தாக்கல் செய்தார். அவற்றில் முதல் மனுவில், "நான் மதுரையின் 293-வது இளைய ஆதீன மாவேன். என்னை இளைய ஆதீனமாக நியமித்து பல்வேறு பணிகளை செய்யும்படி கூறிய ஆதீனம் திடீரென்று எந்தவித அறிவிப்பும் இல்லாமல், என்னை அந்த பொறுப்பில் இருந்து நீக்கி விட்டதாக அறிவித்துள்ளார். 

மடத்தின் சட்ட விதிகளின்படி இது தவறாகும். எந்த குறைபாடுகளும் இல்லாத நிலையில் என்னிடம் விளக்கம் பெறாமல் என்னை நீக்குவதற்கு மதுரை ஆதீனத்திற்கு உரிமை இல்லை. 

அத்துடன் இளைய ஆதீனமான நான் மடத்திற்குள் பூஜைகளை நடத்த வேண்டும். ஆனால் நானும், எனது தரப்பினரும் மடத்திற்குள் வருவதற்கு மதுரை ஆதீனம் தடையாக உள்ளார். எனவே என்னையும் என் தரப்பினரையும் மதுரை ஆதீனத்திற்குள் சென்று வர அனுமதி அளிக்க வேண்டும்,"' என்று கூறப்பட்டுள்ளது. 

அதேபோல மற்றொரு மனுவில், ‘‘இளைய ஆதீனமான என்னிடம் கலந்து பேசாமல் திடீரென்று தம்புரான் ஒருவரை மதுரை ஆதீனம் நியமனம் செய்துள்ளார். இதுபோல தம்புரான் நியமிக்கும் வழக்கம் மதுரை ஆதீனத்தின் விதிகளில் இல்லை. எனவே விதிகளுக்கு மாறாக உள்ள அந்த நியமனத்தை ரத்து செய்ய வேண்டும்.'' என்று கூறப்பட்டுள்ளது. 

இநத மனுக்கள் நீதிபதி கே.குருவையா முன்பாக விசாரணைக்கு வந்தன. அப்போது ஆதீனம் தரப்பு வக்கீல்கள் வி.நாகேந்திரன், ஜெ.ராமமூர்த்தி ஆகியோர் ஆஜராகி, இந்த வழக்குகளுக்கு பதில் மனு தாக்கல் செய்ய கால அவகாசம் வழங்க வேண்டும் என்று கேட்டுக்கொண்டனர். 

இதையடுத்து நித்தியானந்தா தாக்கல் செய்த மனுக்கள் மீதான விசாரணையை வருகிற 15-ந் தேதிக்கு நீதிபதி தள்ளி வைத்தார்.

கோர்ட்டில் நடந்து வருகின்றன.இந்நிலையில், நேற்று நித்யானந்தா தரப்பில்

மேலும் 2 வழக்குகள் தாக்கல் செய்யப்பட்டது. இதில்,என்னை இளைய ஆதீனமாக

நியமித்த பின், பொறுப்பில் இருந்து நீக்கியதாக அறிவிக்க அதிகாரம் இல்லை.

இளைய ஆதீனம் என்ற முறையில் பூஜை செய்ய தடை விதிக்கிறார். என்னை மடத்தில்

நுழைய அனுமதிக்க வேண்டும், என ஒரு வழக்கு தாக்கல் செய்யப்பட்டது.மற்றொரு

வழக்கில், தம்பிரானாக திருச்சிற்றம்பலத்தை நியமிக்கும் உரிமை ஆதீனத்திற்கு

இல்லை. அதை செல்லாது என அறிவிக்க வேண்டும், என தெரிவிக்கப்பட்டது.நீதிபதி

குருவையா வழக்கை பிப்., 15க்கு தள்ளிவைத்தார்.

Principal Sub-judge K. Guruviah, on Monday, dismissed a petition filed by Nithyananda, seeking to thwart a bid by Madurai Aadheenam Arunagirinathar to dissolve a trust formed in association with the former.

According to Nithyananda, the Aadheenam did not consult him before attempting to dissolve the trust registered in both their names. Therefore, the court should pass orders forbidding the Aadheenam from dissolving the trust, he pleaded. 

However, the Aadheenam claimed that the trust was formed under the Madurai Mutt and hence there was no necessity to get approval from Nithyananda. 

The judge held that Nithyananda’s claims were unwarranted and dismissed the petition.
